These Terms of Service ("Terms") are a binding agreement between you and Machine Digital Inc., doing business as StayLift ("StayLift," "we," "us," or "our"), governing your use of stayliftco.com and our services (collectively, the "Services"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
The teardown is offered free and is informational only. It reflects our opinion based on the information available to us. It is not a guarantee of any particular outcome, ranking, occupancy, or income, and it does not create a co-hosting relationship by itself.
If you engage us as a co-host, you remain the owner of your property, your listing, and your platform accounts. We operate within the terms of Airbnb and any other booking platform you use, via access you grant us, and you may review, adjust, or revoke that access. You are responsible for complying with applicable short-term-rental laws, permits, taxes, and platform rules for your property.
For client direct-booking sites, guest payments are processed by Stripe directly into the owner's own Stripe account. StayLift does not take custody of guest funds. We invoice our agreed fee separately. Your use of Stripe is also subject to Stripe's terms.
You agree not to misuse the Services, including by: violating any law or third-party rights; submitting false information; attempting to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Services; or using the Services to send spam or harmful content.
The Site, its content, branding, and our underlying technology are owned by StayLift or our licensors and are protected by law. We grant you a limited, non-exclusive, revocable license to use the Site for its intended purpose. You keep ownership of content you provide to us (such as your listing materials) and grant us the rights needed to deliver the Services.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, StayLift and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amounts you paid us in the three (3) months before the claim or US $100.
You agree to indemnify and hold harmless StayLift from claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your property or listing, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally will be settled by binding arbitration in Sacramento County, California, except that either party may seek injunctive relief in court for intellectual-property or unauthorized-use claims. You and StayLift agree to resolve disputes on an individual basis and waive any right to a class action, to the extent permitted by law.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the Services means you accept the updated Terms.
